is getting a notice to appear from the d.a office the same as from the court system?
I RECEIVED A NOTICE TO APPEAR FROM THE D.A. OFFICE ON A REPORT OF A COMPLAINT THE O.C. SHERIFFS TOOK ON A LADY WHO DROPPED A POUCH AT THE FAIR, THEN AFTER WE GAVE IT BACK SHE CLAIMED IT WAS MISSING MONEY. I NEVER OPENED IT, AS THIS ALL TOOK PLACE IN A MATTER OF MINUTES AFTER IT WAS CLEAR IT WAS HERS. REMEMBER, IT WAS FOUND ON THE GROUND. AND A WITNESS POINTED TO US THAT WE HAD IT, BUT I NEVER SAW HER AROUND IT SO DIDNT HAND IT OVER IMMEDIATELY. FINALLY WHEN FAIR SECURITY CAME ALL OVER THE PLACE WE DID, BUT THEN SHE CLAIMS ITS MISSING MONEY. I WAS NEVER OUT OF SITE, THIS IS WRONG AND FALSE. NOW I HAVE TO GO ENTER A PLEA ON THE MISSING PROPERTY CHARGE. HOW CANT HIS BE IF NO ONE SAW ANYTHING BEING REMOVED? YES, IT WAS FOUND, AND LATER GIVEN BACK, BUT NOTHING TAKEN. IT WAS 5 MINUTES OR LESS THAT SHE HAD HER PURSE BACK. I WAS WITH MY KIDS, AND NEVER WOULD HAVE DONE THIS . IN FACT I DIDNT FIND IT, MY B.F. DID AND GAVE IT TO ME TO HOLD. NOW IT TURNED INTO THIS AND I AM IN DISBELIEF.
YES!!! A notice to appear from the DA’s office is the same as a court order. If you fail to appear, then the court will issue a warrant for you.
Your best bet is to go to the arraignment (the date you have to appear) and plead not guilty. Then if you can afford an attorney, get one, if you can’t – let the court know and they can appoint one for you.
